Responsible disclosure:

Information about an individual’s health / genetics is classed as a special category of data under the General Data Protection Regulation (GDPR).

In the UK, The National Data Guardian’s (NDG) Data Security Standards are intended to apply to every organisation handling health and social care information, although the way they apply will vary according to the type and size of organisation.

In the USA, HIPAA (the Health Insurance Portability and Accountability Act) is the standard for protecting sensitive patient data. Any company that deals with protected health information (PHI) must ensure that all the required physical, network, and process security measures are in place and followed.

Somerset ASA does not recommend sensitive health data is captured and processed by another organisation
- app with insufficient levels of security for this purpose, or
- which has not been risk assessed first (as expected under GDPR), or
- which then does not meet the standards expected, or
- which has no contractual agreement in place to process data in line with the organiser's Privacy Policy (as expected under GDPR and NDG/HIPAA), or
- which reserves the right to transfer data internationally to countries which may not operate to equivalent high standards, or
- which shares such data with developers / advertisers etc
